What The Law Says

Assuming that there are no injuries, an OWI with kids in the car starts out with the same base charges as an OWI if you were caught driving alone. However, the additional charges for transporting a minor under the age of 16 while impaired raises the stakes considerably.

A first-offense conviction for child endangerment OWI can result in up to a year in jail, up to $1,000 in fines and suspension of your driver’s license.

If you are convicted of the same offense a second time within seven years, the penalties are multiplied: Up to 5 years in prison, up to $5,000 in fines, license revocation and additional consequences like probation and/or community service.
