Having multiple DWI convictions on your record can turn your next drunk driving offense into a felony. Felony charges involve much higher penalties than misdemeanors, including larger fines and prison time.
There are many aggravating factors that raise the level of a DUI/DWI offense to a felony, including:
- Two prior DUI convictions
- Children present in the vehicle
- Causing death or serious injury to others
A recent law in Michigan, known as Heidi’s Law, allows for subsequent DUI arrests to be charged as felonies where there are at least two prior drunk driving convictions. There are many challenges we can bring against your felony DUI/DWI charge that range from challenging the officer’s decision to pull you over (reasonable suspicion) to examining Breathalyzer Datamaster logs to assess whether the device was properly maintained.
