DUI Conviction Consequences for College Students

DUI Conviction Impact on Undergraduate and Graduate Admission

Most college and graduate school applications inquire about criminal convictions. Because DUI convictions are not allowed to be expunged in Michigan, it may show up on any criminal background search conducted by the school. Depending on the school and the nature of the program, a DUI conviction may potentially bar you from admission. Some schools have a zero tolerance policy while others only prohibit felony convictions. Some schools are merely seeking honest disclosure of your criminal history along with proof that you have fully resolved your personal and legal issues. You should consult with an attorney for legal advice on how to potentially avoid a DUI conviction and how to properly disclose and counteract the negative implications of your DUI conviction.

College Administrative Consequences

Most Michigan undergraduate and graduate colleges have strict codes of conduct that govern their student body. For example, if you are currently enrolled at a university, and obtain a DUI conviction that is found to be a serious violation of the student code of conduct, you may be suspended or denied continued enrollment.

During an administrative hearing, a disciplinary committee will gather to discuss the facts of your case and determine if you will receive any type of reprimand. Such consequences may consist of verbal warnings to expulsion. You should definitely consult with an attorney prior to attending an administrative hearing. It may also be in your best interest to take an attorney with you to the hearing for representation. Note, every college has its own policy regarding drug and alcohol use.

Future Career Consequences

Most employers ask about criminal convictions on job applications. Some ask only about felony convictions while others ask about all types of convictions. As mentioned above, because DUI convictions cannot be expunged in Michigan, an employer may be able to detect your conviction while performing a criminal background check. If an employer learns that you lied on your application, you can be terminated for dishonesty. Therefore, it is best to disclose your conviction upon request. But, it is also best to be prepared to prove to the employer that you have completely resolved any personal and legal issues related to the DUI conviction. Many employers will be forgiving where there is no pattern of DUI convictions and continuing alcohol or substance abuse that will interfere with your ability to perform the job.
