Man may be facing DWI charge after crashing into trees

It is often true that news stories about arrests and possible criminal conduct are based on information provided by police. While this is understandable, it has the unfortunate side-effect of not necessarily giving the suspect a fair shake. That may be the case with an alleged Driving While Intoxicated (DWI) or drunk driving incident in Washtenaw County.

Early in the morning of December 11, a man was reportedly arrested after his 2011 Ford F-series pickup truck allegedly crashed into several trees on Monroe Street in Saline. Emergency personnel quickly responded to the incident and had to stabilize his spine before transporting him on a backboard to St. Joseph Mercy Hospital. His current condition was not available, and the man's identity had not yet been released.

Police, however, are claiming that the man had been drinking on Saturday evening in Ann Arbor. They also further allege that the man himself admitted to drinking five to six beers between 6 pm and 9 pm. A blood test was performed at the hospital, although the results of that test were not disclosed in a local news story.

For his part, the man is claiming that he simply fell asleep at the wheel. If true, that may still subject him to some liability for any damage he caused but it would not necessarily amount to criminal conduct. Moreover, even if he had been drinking the prior evening, it may well be that enough time had passed for his blood alcohol level to drop below the legal limit.

To raise these defenses, this individual will need to put forth a strong and meaningful defense against any possible DWI charge. Washtenaw County residents who are in a similar predicament may wish to seek legal assistance in their bid to secure a fair result.
