Michigan Driver's License Suspension

When you are initially arrested for a DUI in Michigan, the arresting police officer will confiscate your driver's license and provide you with a temporary permit. If you refuse to take the breathalyzer or other chemical test , you will have 14 days to request an implied consent hearing before the Secretary of State Driver Assessment and Appeal Division. During the hearing, you and the arresting officer will be provided the opportunity to testify as to the facts of the arrest and chemical test refusal.

If the arresting officer does not show up for the DAAD implied consent, your license will likely be restored. If the officer does show and presents convincing evidence of a valid arrest but unreasonable refusal, your driver's license will be suspended for one year. However, you may be able to appeal to a circuit court judge for a license based on hardship.

DUI license sanctions range from a 90 day suspension (with restrictions), 6 month suspension (with 30 days of no driving), to complete revocation of your license for one to five years. If you violate any license restrictions, your license will be suspended again.
