DWI charges may follow Pittsfield Township accident

On Sept. 27, two drivers were injured in a collision on Carpenter Road in Pittsfield Township, Michigan. The accident involved a 2002 Chrysler Sebring driven by an Ann Arbor man, and a 1998 Ford Windstar minivan driven by a man from Pittsfield Township. Neither driver received life-threatening injuries, though both had to be taken to local hospitals for treatment. Although the Sebring's driver said he was drinking prior to crash, no DWI or DUI charges have been filed as of yet. However, it appears police requested the 20-year-old driver of the Sebring to submit to a blood alcohol content test at the hospital, and indications are he consented.

The crash occurred at around 7 a.m., when the Windstar driver attempted to make a left turn onto a private drive from Carpenter Road in the face of oncoming traffic. The Sebring hit the rear passenger side of the Windstar while the minivan was attempting to make the turn. The Sebring driver had to be extracted from his car through the passenger side, after which he was taken to St. Joseph Mercy Hospital. Results of the blood test were not yet available.

But police also stated, after interviewing a witness, that it was not clear whether the Sebring driver could have done anything to avoid the crash. Speed is also not believed to have contributed to the accident. If the Ann Arbor man is later charged with DUI or DWI, these two factors will be important elements for a court to consider.

Although no charges have been filed yet, the Sebring driver may benefit from consulting with an experienced defense attorney intent on helping those charged with drunk driving offenses. Indications are that the minivan caused the accident by failing to yield the right of way to the Sebring driver. Nevertheless, it is the Sebring driver that may have legal difficulties for drinking and driving.
