Michigan No-Fault Divorce Attorney
Michigan law provides for no-fault divorces. A no-fault divorce is when neither party is blaming the other party for the breakdown and dissolution of the marriage. For marriages with no minor children, there is a 60 day waiting period before a divorce can be finalized. For marriages with minor children, there is a 6 month waiting period before a divorce can be finalized.
In a no-fault divorce, if both parties agree on the division of property, child custody, visitation or parenting time, and support issues, there can be a huge monetary and emotional savings to both parties. Where the parties cannot amicably agree on these matters, mediation and/or trial may be appropriate.
Mediation is where a trained mediator assists the parties in reaching a fair and equitable resolution. Litigation or trial means that a judge will review evidence and make a decision for the parties. Particularly where there are minor children, pensions or retirement funds, or high assets, it is important to speak with an experienced divorce lawyer.
An experienced attorney will advise you as to your rights and what is best. Attorneys and websites that offer cheap, quick, no-fault divorces may overlook assets that you may be entitled to and other important issues. Similarly, representing yourself can be a very big, costly mistake. Once a divorce is final, you cannot re-do it without showing a significant change in circumstances or, often, great expense. Therefore, it is important to do it right the first time.
